1. Introduction & Acceptance

By accessing or using the website operated by Short Stuff Supply Co. (“we,” “us,” “our,” “Company”) via [https://www.shortstuffsupplyco.com/], by placing an order through the Site, you (“you,” “Customer,” “User”) accept and agree to be bound by these Terms & Conditions and our Privacy Policy, which is incorporated by reference and may be updated from time to time. If you do not agree to these Terms, you should immediately cease using the Site.

2. Eligibility

You represent and warrant that you are at least 18 years old and are legally capable of entering into binding contracts. If you are purchasing on behalf of a minor, or the product is for a minor, you represent that you are the parent or legal guardian of the minor and that you accept these Terms on behalf of that minor.
We do not knowingly collect personal information from children under 13 without parental consent (see Section 9).

3. Products, Pricing & Availability

3.1 Product Descriptions: We strive to ensure accurate product descriptions, images and pricing, but we cannot guarantee that everything is error-free, complete, or current.
3.2 Pricing & Changes: Prices shown on the Site are in U.S. Dollars unless otherwise noted. We reserve the right to change prices, correct errors, or modify or discontinue products without prior notice.
3.3 Availability: Some items may become unavailable after you place an order. If so, we will notify you and refund any payment made for the unavailable product.
3.4 Consumer Protection (Colorado): In compliance with the Colorado Consumer Protection Act (C.R.S. 6-1-101 et seq.), we do not engage in unfair or deceptive trade practices, including misrepresenting product quality, availability or pricing.

4. Orders & Payment

4.1 Order Acceptance: Receipt of an order confirmation does not constitute acceptance of your order. We may refuse or cancel orders at our discretion (e.g., pricing errors, product availability, payment issues, suspicion of fraud).
4.2 Payment Terms: We accept the payment methods presented at checkout. By providing payment information, you certify that you are authorized to use the payment method and that information provided is correct and complete.
4.3 Taxes & Fees: You are responsible for applicable sales tax, duties, customs or other governmental charges. If applicable, we will collect and remit sales tax for orders shipped to Colorado residents according to Colorado law.

5. Shipping, Delivery & Risk of Loss

5.1 Shipping: We will ship to the address you provide. Shipping costs and estimated delivery times will be provided at checkout or otherwise communicated.
5.2 Delivery Estimates: Delivery times are estimates only and commence from the date of shipment, not order. We are not responsible for delays caused by carriers, weather, customs, or other events beyond our control.
5.3 Risk of Loss: Title to and risk of loss for items purchased passes to you when we deliver the items to the shipping carrier.

6. Returns, Refunds & Exchanges

6.1 Return Eligibility: Subject to applicable laws, we accept returns or exchanges of eligible items within [ X ] days of delivery, provided the items are unused, unwashed, in original condition, with original tags and packaging.

7. Intellectual Property

All trademarks, service marks, trade names, text, graphics, logos, images, videos, data and other content on the Site (“Content”) are the property of Short Stuff Supply Co. or its licensors and are protected under U.S. and international intellectual property laws. You may not reproduce, distribute, display, modify or exploit any portion of the Site or Content without our prior written permission.

8. User Accounts & Security

If you create an account on the Site, you agree to provide accurate, current and complete information. You are responsible for the security of your account credentials and for all activity under your account. You agree to promptly notify us of any unauthorized use or security breach involving your account.

9. Privacy & Children’s Data Protection

9.1 Children’s Online Privacy Protection Act (COPPA): We respect children’s privacy and comply with the federal Children’s Online Privacy Protection Act (15 U.S.C. 6501 et seq., and 16 CFR Part 312). 10.2 Our total liability for any claim relating to a product or purchase from the Site shall not exceed the purchase price you paid for that product.
10.3 Some jurisdictions (including Colorado) may not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Governing Law; Dispute Resolution

13.3 Waiver: Our failure to enforce any right or provision of this Agreement will not constitute a waiver of such right or provision.
13.4 Assignment: You may not assign or transfer this Agreement or any rights or obligations hereunder without our prior written consent. We may assign or transfer this Agreement at any time without restriction.
